PUBLIC ENGAGEMENT NOTICE AND PROGRAM ON THE PROPOSED IMPLEMENTATION OF REFUSE COLLECTION SERVICE IN IDENTIFIED AREAS THROUGH AN EXTERNAL MECHANISM.

The Council of Emalahleni Local Municipality acting in terms of section 156 (1) of the Constitution of the Republic of South Africa, 1996, read with section 78 (3) of the Local Government: Municipal Systems Act, 2000 (Act No. 32 of 2000) and Council resolution A. 103/21 hereby give this notice of public engagement set forth hereunder for public comment:
Background to the public engagement notice
The Emalahleni Local Municipality has a Constitutional obligation to provide a clean and a healthy environment for its inhabitants. To this end, the municipality is obliged to provide acceptable, affordable and sustainable waste collection service to households in line with the National Domestic Waste Collection Standards (2013).
 
Whereas the rapid growth of the municipality stifles the municipality’s efforts to adequately meet its obligation of providing effective refuse collection services, the shortage of refuse collection resources has also compromised the provision of refuse collection services for the past many years.
 
In responding to the challenge of inadequate provision of refuse collection services, the municipality commissioned a section 78 Study in 2019, which sought to investigate different waste management delivery options that are available for the municipality to implement. The Study recommended amongst others that the municipality should adopt and implement an alternative “External” model of providing ‘core waste management services’ so as to ensure that the municipality meets its legal obligations that will promote a healthy environment. The ‘External’ model entails, amongst others, the provision of refuse collection services through the use of external service providers.
 
Purpose of the public engagement notice
This public engagement notice seeks to inform and encourage residents in the affected areas (mentioned below) to participate in the consultation process to obtain public opinion, views and representation with regard to the proposed external model of refuse collection. The affected areas are; Bankenveld, Reyno Ridge, Ben Fleur, Duvha Park, Tasbeth Pak, South View and Kyalami.
 
Proposed Service Delivery Outcomes
A draft document of the proposed service delivery outcomes for the provision of refuse collection through external mechanism will form the basis of the service delivery agreement that shall be entered into between the municipality and the service provider. The document is available on the following municipal website: www.emalahleni.gov.za.
