This notice is served in terms of section 13 of South African Local Government Municipal Systems Act, 2000 (Act no. 32 0f 2000) read together with section 162 of the Constitution of the Republic of South Africa, 1996 (Act no 108 of 1996) on the compliance of ELM Community Fire Safety By – law.
The Municipal Council is mandated by the Constitution of the Republic of South Africa, 1996 and other pieces of legislations governing Local spheres of Government to exercise its legislative Authority and promote a Safe and Healthy Environment for its local communities.
Chapter 10 of this By – law suggest that the municipality may designate any public place or street , or any part thereof within the municipal area as the only place at which fireworks may be discharged, it is in line with this background that the Municipality has identified the following areas to be used by the community to discharge fireworks on the 31st of December 2024 from 23H00 to 01H00, the 01st January 2025;

▪ Open space next to Sy – Mthimunye Stadium
▪ Empumelelweni sports field
▪ Emsagweni sports field ( next to extension 14)
▪ Klipfontein Dam
▪ Ga -Nala sports field ( Next to civic center)
▪ Ga – Nala Rugby Field
▪ Pine Ridge Stadium
▪ Eric Liberty sports field
▪ Thubelihle sport field
▪ Hlalanikahle sports field ( Hlalani Kahle x 4)
▪ Puma stadium
▪ Phola open space ( next to Phola Police station)
CONTROL OF FIRE WORKS
- No person may light, ignite or detonate in any place where animals are present
- No person, under the age of 16 years may purchase fire works from any retail dealer, or possess any fireworks, light or ignite any fire works
- Unless so authorised in terms of section 55 of the By – law, no person may light or ignite fireworks on any day or at any time, except on a New Years Eve from 23h00 to 01h00
SALE AND DEALING WITH FIRE WORKS
- No person may sell fireworks , unless he / she holds the required fireworks license issued in terms of Explosives Act, 2003 ( Act no.15 of 2003)
- and has written Authority from both the South African Police Services and the Municipal Chief Fire Officer.
- The import and sale of fireworks without the necessary permissions outlines in the Explosives Act is illegal
The Public / Community is urged to report any illegal sale and display of fireworks on undesignated areas to-the following Municipal call centre number, 013 690 6222, 6333, 6444
